Terms of Service

1. Agreement

These terms are an agreement between you and SocialMarks, a service operated from Ontario, Canada. By creating an account or using the service, you accept these terms. If you do not agree, do not use SocialMarks.

2. What SocialMarks does

SocialMarks lets you save social posts, organize them into collections, and use AI to summarize them and answer questions about what you saved. We may add, change, or remove features over time.

3. Your account

You sign in with a one-time code sent to your email, so keeping access to that email address keeps access to your account. You are responsible for activity under your account. Tell us right away if you think someone else has access.

4. Acceptable use

You agree not to:

  • Save or store content that is illegal or that you have no right to save.
  • Break, overload, probe, or reverse engineer the service.
  • Use the service to harm others or violate their rights.
  • Resell or redistribute the service without our permission.

5. Your content

You keep ownership of the content you save. To run the service, you grant us a limited license to store, process, and display that content back to you, including sending it to our AI provider to generate summaries and answers. You are responsible for having the right to save the content you add.

6. Third-party platforms

Posts you save belong to their original authors and the platforms they come from. SocialMarks is not affiliated with, endorsed by, or operated by X, TikTok, Instagram, or any other platform. Your use of those platforms remains subject to their own terms.

7. Plans and billing

  • The free plan includes 25 saves at no cost and no card required.
  • Pro is $15 USD per month or $120 USD per year and includes unlimited saves.
  • Payments are handled by Stripe. Paid plans renew automatically until you cancel.
  • You can cancel anytime from the Billing page. Cancellation stops future charges. Your Pro access runs until the end of the period you already paid for.
  • Charges are generally non-refundable. If something went wrong, email us and we will make it right where we can.

8. Cancellation and termination

You can stop using SocialMarks and delete your account at any time from the Billing page. We may suspend or close an account that violates these terms or puts the service or other users at risk.

9. Disclaimers

SocialMarks is provided as is, without warranties of any kind. We do not promise the service will be uninterrupted or error free, and AI generated summaries and answers may be inaccurate. You use the service and rely on its output at your own discretion.

10. Limitation of liability

To the extent the law allows, SocialMarks is not liable for indirect, incidental, or consequential damages, or for lost data or profits. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

11. Changes

We may update these terms as the service evolves. When we do, we will revise the date above. Continuing to use SocialMarks after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there, without regard to conflict of law rules.
